Ann Smith is an experienced litigator who represents management in all aspects of employment litigation, including defending claims for wrongful termination, discrimination, harassment, retaliation and leave of absence violations. Ms. Smith handles numerous matters in state and federal courts and before various administrative agencies, including the U.S. Department of Labor, the Equal Employment Opportunity Commission, the Civil Rights Department, and the California Department of Labor Standards Enforcement.

Ms. Smith counsels clients on a variety of employment issues, including employee discipline, wage and hour compliance and adherence to federal and state family and medical leave laws. She frequently drafts employment agreements, personnel policies and compensation plans. Ms. Smith is the Chair of AALRR’s Disability Leave Committee, which meets regularly to discuss disability leave issues, including new cases and pending legislation.

Recent amendments to the PAGA statute have generated more confusion than guidance about these lawsuits and what effective actions employers can take to protect themselves. This presentation offers practical guidance on navigating the evolving wage and hour litigation landscape and the proactive measures employers can take now to strengthen compliance efforts and position themselves for a successful defense when faced with class and PAGA litigation.

Key Objectives:

1. Understand the difference between class action claims for unpaid wages and PAGA claims for civil penalties.
2. Know what to do (and what not to do) when you first receive a “PAGA Notice Letter” or lawsuit.
3. Distinguish between “curing” alleged Labor Code violations and taking “reasonable steps” to comply with the Labor Code.
4. Evaluate the most common wage and hour policies and practices that are the subject of lawsuit.
5. Implement 10 proactive measures to defuse allegations of systemic and unlawful wage and hour practices.
