California Assembly Bill 5 (AB 5), signed into law on September 18, establishes difficult standards for classifying workers as independent contractors.
Many California companies have already been adopting modified practices following the California Supreme Court’s 2018 decision in Dynamex Operations West, Inc. v. Superior Court to ensure compliance and to minimize misclassification claims. Following the passage of AB 5, it is even more important to have a clear understanding of the current legal standards, and to apply appropriate compliance safeguards.

Kathryn T. McGuigan is a Partner with the law firm of Morgan, Lewis & Bockius LLP where she focuses her practice on representation of management in all areas of labor and employment. She also provides day-to-day advice and counsel on a broad range of labor and employment issues under both state and federal law. Prior to law school, she was the Vice President, Human Resources for FoodBrand, LLC, a mall-based multi-concept restaurant operator and spent eight years at Sizzler International Inc. as Vice President, Administration. She received her undergraduate degree from Loyola Marymount University and her Juris Doctor from Pepperdine University School of Law.
